Jamie Foxx has been accused of sexual assault in new lawsuit

American actor Jamie Foxx has been accused of an alleged sexual assault which took place in 2015 in a newly filed lawsuit.

The incident supposedly occurred on the rooftop of New York restaurant Catch. The woman filing the claim posits that she and her friend were seated near the actor and Mark Birnbaum, the co-founder of Catch Hospitality Group.

The two groups chatted after the plaintiff and her friend asked Foxx for a photograph, to which the actor responded, “Sure baby, anything for you.”

Foxx began complimenting the plaintiff by comparing her to Gabrielle Union before stating, “You smell so good,” and “Wow, you have that super model body.”

This led Foxx to take the plaintiff to a more private part of the rooftop, where he proceeded to assault her. During the assault, the woman noticed that a security guard failed to intervene despite witnessing her discomfort.

The lawsuit alleges that Foxx “put his fingers on and in Plaintiff’s vagina and anus.” Alongside the security guard, the woman also cites Birnbaum and the Catch employees as defendants, believing they enabled the assault.

According to the suit, the plaintiff “suffered and continues to suffer severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder and other physical and emotional damage.”

The suit has been filed under New York’s Survivors Act, which opened a year-long window to file sexual assault claims that the statute of limitations would have otherwise barred. It is one of many suits filed before the deadline this week.
